These Terms of Use apply to all Training Discount Vouchers issued by BigRedSky
Limited.

"Voucher Serial
Number" means the 8-digit number prefixed with BRS that appears on your Training Discount Voucher;
"BigRedSky" means BigRedSky
Limited ABN 95 125 963 788 of 471
Murray Street, Perth, Western Australia 6000;
"Training Discount Voucher" means
the Training Discount Voucher that
you have received;
A reference to "Company" is
a reference to BigRedSky Limited;
A reference to "you" or "your" is a
reference to the person who is in possession of the Training
Discount Voucher at the relevant time for the purposes of these Terms of Use,
or who authorises another person to do something with or to the Training Discount Voucher on their behalf.
1. Introduction
This document contains the full
set of terms of use governing your use of the Training
Discount Voucher. The Company recommends that you read this document carefully
before using the Training Discount Voucher.

These Terms of Use are effective
for all Training Discount Vouchers issued after 22 January 2009.

Accepting the Training Discount Voucher and agreeing to these
Terms of Use
By accepting, redeeming or
attempting to redeem a Training Discount
Voucher, you:
- accept
and agree to be bound by these Terms of Use; and
- acknowledge that you have read and
understood the BigRedSky Privacy Statement available from www.bigredsky.com.
3.
Training Discount Voucher Inclusions &
Exclusions
BigRedSky ASAP Corporate Solution
Training Discount Voucher is only redeemable at
BigRedSky Limited for payment of standard
training services received by you from the Company.
BigRedSky
ASAP Corporate Solution Training Discount
Voucher can not be redeemed for:
- Payment
of customised training services
received by you from the Company; nor
- Payment
of an account for goods and services which are not standard training
services received by you from the Company.
Your Training
Discount Voucher may only be used for payment of the GST inclusive amount of any standard training services invoiced to you
by the Company by redeeming your Training
Discount Voucher at the time of payment. You may redeem more than one voucher
for the payment of the training services.
Your Training
Discount Voucher may only be used to make payments up to the value of the
voucher or vouchers redeemed. If you wish
to make a payment for an amount that exceeds the value of the voucher(s)
redeemed, you must pay the excess using another payment method.
No change will be given where the
value of the voucher(s) redeemed is greater than the amount payable.
The Company will accept the Training Discount Voucher in accordance with these
Terms of Use and any applicable law.
You acknowledge that the Training Discount Voucher may not be used to pay an
account for goods and services which are not standard training services
received by you from the Company
Your Training
Discount Voucher must be signed by an authorised BigRedSky Ltd representative
to be valid for use.
Your Training
Discount Voucher will be valid for use for one (1) year from the date of issue
(or as otherwise extended by the Company). Training Discount Vouchers will not be redeemable
after the voucher’s expiry.
Re-issue of damaged Training Discount Vouchers is not available.
Treat your Training
Discount Voucher like cash. Lost or stolen vouchers will not be replaced or
refunded.
You cannot exchange your Training Discount Voucher for another Training Discount Voucher or for cash.
5.
Your Training Discount Voucher, your responsibility
You are responsible for the use
and safety of your Training Discount
Voucher. You are liable for all transactions with your Training
Discount Voucher, except to the extent to which there has been fraud or
negligence by the Company or by any of the Company’s employees.
6. Changes to Terms of Use
The Company reserves the right to
change any of the terms contained in these Terms of Use at any time where the
change is required:
- To
add or remove services for which the Training
Discount Voucher may be redeemed;
- For
infrastructural, systems, administrative or operational reasons or to
prevent the occurrence of fraud or other unlawful or unacceptable conduct;
- To
comply with any contract, law, regulation or statute or order or judgment
of any court, tribunal or other body having competent jurisdiction; or
- Where
the Company, acting reasonably, consider that it will not be to your
detriment.

will be available at www.bigredsky.com or by contacting 1300 733 056.
The BigRedSky Privacy Policy explains
how the Company handles the personal information that may be collect from you
with respect to Training Discount Vouchers.

It is important that you
carefully read and understand the applicable Privacy Policy.
8.1.
Training Discount Vouchers
If you have reason to believe
that an error has occurred in relation to your Training
Discount Voucher, you should call 1300 733 056.
8.2.
Training services
Any complaints about training
services purchased with a Training Discount
Voucher must be resolved directly with the Client Relationship Manager at
BigRedSky by calling 1300 733 056.
To the extent permitted by law, the
Company will not be liable to you for any loss or damage (whether direct or
consequential), nor be in default under these Terms of Use, for failure to
observe or perform any obligations under these Terms of Use for any reason or
cause which could not, with reasonable diligence, be controlled or prevented.
These causes include acts of God, acts of nature, acts or omissions of
government or their agencies, strikes or other industrial action, fire, flood,
storm, riots, power shortages or failures, sudden and unexpected system failure
or disruption by war or sabotage, and other acts or omissions of third parties.
These Terms of Use are to be
construed and enforced in accordance with the laws of Western Australia. Any dispute arising from
your receipt or use of a Training Discount
Voucher is exclusively subject to the jurisdiction of the courts of Western Australia and
any courts that may hear appeals from those courts in respect of any
proceedings in connection with these Terms of Use.
