BIGREDSKY LIMITED GENERAL PRIVACY POLICY

1. Introduction
This General Privacy Policy sets out how BigRedSky Limited (BigRedSky) handles personal information, which you may provide as a job seeker of this Website and of BRS Application Service Provider eRecruitment Management Software solutions (BRS ASP).

BigRedSky has adopted the National Principles for Fair Handling of Personal Information introduced by the Australian Federal Privacy Commission and as supported by the Privacy Amendment (Private Sector) Bill 2000. BRS is committed to treat all personal information in line with the best privacy practices.

Please note that in addition to these statements BigRedSky is committed to comply with the Internet Industry Association's Internet Industry Code of Practice. The current version of this Code of Practice may be viewed at: www.iia.net.au.

The following Privacy Policy is applicable to job seekers whom respond to job applications posted on Client's branded BRS A.S.P. website, and to job seekers whom have registered with Client's branded BRS A.S.P.


2. BRS ASP purpose
BRS ASP is a Client (the recruiting organisation) specific branded database which enables the job seeker to respond to job applications advertised by the Client. Each Client has it's own secure database as a segment of the main BRS ASP database, all centrally stored on a BRS ASP server, sharing the advantages of low Total Costs of Ownership, security and upgradeability.

No data can be shared or accessed between one Client and another, even though their databases may reside on the same physical servers.

BRS may appear transparently as being fully integrated into a Customer's website, or as a standalone website "backend" branded as the Client organisation.

BigRedSky has no interest in intervention or access to any data provided on a Customer 's BRS database, other than if BRS has been granted access specifically by the Customer for the purpose of fault rectification or data export for the Customer's own specific use.

BigRedSky will enforce the security and privacy of job seeker data to the extent of our rights within the ASPLA (Application Service Provider Licence Agreements) between the Customer and BigRedSky, which details the obligations of each part in respect to the use of information on the site and Customer databases.

BigRedSky will be indemnified by the Customer for any breach of Privacy of Customer data or Job seeker data, according to the BigRedSky General Terms and Conditions and Terms of Use, and BigRedSky General Privacy Conditions.


3. Data Quality, Access & Correction
If you are an applicant to an advertised position, or as a job seeker placing your details on any BRS ASP. powered Client website database, you are responsible for ensuring your information is accurate. If you apply for a particular position you cannot amend your application once your have sent your application to the recruiter. If you are a registered member of a BRS ASPpowered Website, you can access the information that you have provided at any time by entering your user name and password, or you can contact us if you wish us to amend your records for you. We can only amend your records if you give us your user name and password. If you do this, we will request that you change your password as soon as possible. BRS will not be responsible for any unauthorised use of the password as a consequence of a failure to change your password upon our request.


4. Collection of Personal Information
BigRedSky has no interest in the collection of personal information of job seekers EXCEPT when BigRedSky incorporates the BRS A.S.P. Services into their own website for their own use as an employer seeking applications to genuine job advertisements. The BRS A.S.P. system collects your personal information as provided by you, on behalf of the organisation for which you have submitted the information. This information is stored in a database to be used exclusively by that organisation. The BRS system will only collect personal information from you that is necessary to:

(i) Properly assess your request and provide you with services enabled by using BRS Products;

(ii) notify you of any administrative matters; or

(iii) notify you if your access to our services will be suspended for any reason. We will only collect personal information that you voluntarily provide by using this Website or by any other method agreed to by you.


We will not collect information about you from anyone else unless we are acting in our capacity as a Recruiter. If we are acting as a Recruiter for a third party, we may adopt verification procedures to check the accuracy of your personal information in processing job applications.


5. Cookies
Cookies are pieces of information that a website can transfer to an individual's computer hard drive. Cookies can be used for record keeping and statistical information, and to maintain a connection between the user and a database on a web server. Cookies can make using websites easier to use by storing information about your preferences on a particular website. The information remains on your computer after the Internet session finishes. Many people find the concept of Cookies intrusive, therefore most popular Internet browsers have the ability to warn the user of Cookies, or disable them from being stored on the user's computer.

BRS requires that a Cookie is transmitted and stored on the user's computer soley to maintain the connection between the website server and the user (job applicant). This is called a session variable for the purposes of BRS Services. BRS may, however, choose to use cookies for other purposes to improve BRS Products. If you normally prefer not to receive cookies, you can adjust your Internet browser to warn you when cookies are being used.


6. Use and Disclosure of Information
Our licence agreement with organisations that use BRS products and services to facilitate the advertising of job vacancies and the receipt of applications requires those organisations to employ similar Privacy policies and principles. Specific Privacy statements of those organisations should be read in conjunction with this General Privacy Policy.

We will only use personal information you provide to us for the purpose of providing you with the service or product you have requested. We will not sell, rent, trade, share, reveal or disclose any of your personal information, unless:

· you have specifically requested that we do so;

· it is necessary to provide you with services you have requested;? we are required to do so by a Court of competent jurisdiction or by Governmental order, decree, regulation or rule of any regulatory agency;

· our terms and conditions state that we will (for example see Clause 7 of this policy);

· we reasonably believe that use or disclosure is necessary to prevent or lessen a serious and imminent threat to an individual's life, health or safety or a serious threat to public health or safety; or

· we have reason to suspect that unlawful activity has been, is being or may be engaged in and the use or disclosure of your personal information is a necessary part of our investigation of the matter or in reporting our concerns to relevant persons or authorities.

We may provide aggregate information and statistics about users of the Website, traffic patterns, and related site information to third parties, but these statistics will include not include individual personal information.

We will not use your personal information for any purpose not disclosed in this Privacy Policy or the Terms of Use, unless we have obtained your consent to do so.


7. Deletion of Personal Information
We may retain some personal information to troubleshoot problems or enforce any of the Terms of Use. Further, the personal information you have supplied to us, although archived within our systems and made inaccessible, may never be completely removed from our databases due to technical constraints and the fact that we back up our systems. Similarly, the nature of the internet involves many different servers and internet service providers, many of which will back up data. Although your information is largely inaccessible and unidentifiable, the data does remain. It is not possible to entirely eliminate data from the internet.


8. Data Security
We have taken the following steps to protect the personal information we hold from misuse, loss, unauthorised access, modification or disclosure.

We will take all reasonable measures to ensure the privacy of personal information. We will take reasonable steps to ensure that all information we collect, is stored in a secure environment accessed only by authorised persons. Transmissions sent to, or from BRS powered sites are continuously monitored for intrusion and quality control. Unfortunately, no data transmitted over the Internet is secure.

9. Identifiers
We will not use as our own, adopt or disclose any identifier that has been assigned to you by a government agency.


10. Anonymity
Given the purpose of this Website it is not practical to deal with you anonymously. You may choose, of course, not to deal with us.


11. Onwards transfers of personal information
We will only transfer personal information to a third party if:

(i) we reasonably believe that the recipient of the information is subject to a statute, binding scheme or contract which effectively upholds principles for fair information handling that are substantially similar to these principles; or

(ii) you consent to the transfer; or

(iii) the transfer is necessary for the performance of a contract between you and us, or for the implementation of pre-contractual measures taken in response to your request; or

(iv) the transfer is necessary for the conclusion or performance of a contract concluded in your interest concerned between us and a third party ie, employer or employee as appropriate; or

(v) the transfer is for your benefit, and

(vi) it is not practicable to obtain your consent to the subject of the information to that transfer; and

(vii) if it were practicable to obtain your consent, you would be likely to give it; or

(viii) we have taken reasonable steps to ensure that the information which is transferred will not be collected, held, used or disclosed by the recipient of the information inconsistently with these principles.


12. Sensitive Information
We will not collect sensitive information about you without your prior consent. The BRS ASP effectiveness is not dependent on you providing information that could be regarded as sensitive in the normal course of matching job seeker to recruiter. Any personal information you may provide is done so by you voluntarily, and at your discretion as whether or not you consider it to be advantageous to do so.


13. Amendments to this Policy
BigRedSky may edit this privacy policy from time to time. If we make any substantial changes we will notify you by posting a prominent announcement on our pages.
